PAS, Amanah settle Batu office dispute



PAS and Amanah today settled their legal tussle over a property in Batu, Kuala Lumpur, once used by the PAS division, but which became contentious after several members left for splinter party Amanah.
Both parties entered into a consent judgement before Justice Ahmad Zaidi Ibrahim at the Kuala Lumpur High Court, where PAS agreed to pay RM32,500 as a token to four Amanah members.
After payment is made, possession of the vacant property will be handed over to PAS.
In turn, the Amanah members – Rosden Mohd Yassin, M Suhaimi A Rahaman, Ismail Yahaya and Jamhor Nawawi – will revoke the power of attorney which allowed their party to use the two shop lot units.
The suit had initially been filed by PAS member and property owner Md Mansor Ali, Batu PAS chief Azhar Yahya and PAS against the Amanah members.
However, the court ruled that both PAS and Azhar had no locus standi in the case.
Mansor had also sought to invalidate the power of attorney over the property given to the four defendants on Aug 18, 2015, as well as a declaration granting PAS ownership of the property.
The four defendants, who were PAS committee members for the 2013-2015 term, were among the trustees of said property.
However, they relinquished their positions on March 16, 2015, as they were among a group who left PAS to form Amanah.
Mansor also told the court today that sometime in November 2014, PAS received a notice from Bank Islam regarding arrears in loan repayment on the property.
The defendants had paid RM15,000 each to settle the RM57,766 in arrears between end-2014 or early-2015.
According to court filings by Mansor and PAS, since the four had resigned as Batu PAS committee members, they had no right to make decisions on behalf of the party over said property.
Mansor and PAS also claimed that the four misrepresented themselves sometime in April 2015 with regard to the handling of the property, resulting in the power of attorney being issued to the defendants.
In May 2015, Batu PAS division held an extraordinary general meeting, where it was resolved that they would acquire the property, reimbursing the defendants if necessary.
The Batu dispute was one several ongoing court cases over property rights between PAS and Amanah around the country.- Mkini
