Court rejects loggers' bid to dismantle Orang Asli blockade



In a victory for the Orang Asli of Gua Musang, the Magistrates Court there today quashed a logging company's bid to dismantle the Orang Asli anti-logging blockade.
"The court rejected the company's application in claiming that they have a right to occupy (the land).
"The court agrees that the Orang Asli are the righful occupiers, meaning that they are in control of the area.
"The company failed to prove that by virtue of their permit or licence, they (the company) are the occupier there," said lawyer Siti Kasim who represented the Orang Asli community.
The firm, Jajaran Wawasan Enterprise filed an application under Section 99 of the Criminal Procedure Code in respect of the land in Pos Balar.
In separate blockades last year, the Orang Asli community in Pos Tohoi and Pos Gob also set up blockades to stop logging, but the structures were dismantled by the Forestry Department and more than a dozen were arrested.
The community have since rebuilt their blockades.
Siti said the victory today set a precedent for other disputes pertaining to Orang Asli land rights.
In fact, the Orang Asli of Gua Musang will now use Section 99 to file a court case against the logging firms, she said.

Most of the logging firms blocked by the Orang Asli community have permits from the state.
"The court now recognises the Orang Asli have the right to control the area, not to allow any outsiders to go in without their agreement, especially if the outsiders are going to cause disputes.
"The rule of the court is to ensure no violence will happen from the disputes," she said.- Mkini
