BN ALL OUT TO JAIL TIAN CHUA? BATU MP CHARGED FOR ‘MOLESTING MODESTY’ OF COP – VERDICT TO BE OUT ON FEB 13

PETALING JAYA: A Sessions Court has fixed Feb 13 for decision over the case of Batu MP Tian Chua who was charged with “outraging the modesty” of a policeman via foul language.
Judge Yasmin Abdul Razak set the date after hearing clarifications from Deputy Public Prosecutor Suhaimi Ibrahim and Tian Chua’s counsel Latheefa Koya here on Monday.
Tian Chua whose real name is Chua Tian Chang, claimed trial to accusations that he had outraged the modesty of police assistant superintendent Glenn A. Sinappah by saying “stupid police” and other foul words.
The alleged offence occurred at the main entrance of the Armada Hotel in Section 52, here, at 7.45pm on April 14, 2014.
The offence under Section 509 of the Penal Code is punishable by a five-year prison sentence, fine, or both.
A total of five prosecution witnesses testified while the defence had called two witnesses including Tian Chua, to give their evidence.
Earlier, Latheefa said based on the charge against her client, the words uttered did not fulfil the element under Section 509 of the Code.
She said there was no CCTV evidence or any witnesses to prove the words were uttered by Tian Chua, 54.
“My client had denied saying the words but instead, protested on the seizure of his handphone, which failed to follow procedure,” she said.
She added that Tian Chua’s statement did not cause the police officer or the victim to suffer mentally and emotionally.
DPP Suhaimi rebutted, saying that the offence undermined the dignity of a police officer who was carrying out his duty.
