In yet another case of justice delayed, there is no indication from the Malaysian High Commissioner's office in Australia whether an amended statement of claim by Mongolian Shaariibuu Setev has been successfully delivered to former Special Action Unit member Sirul Azhar Umar, who is being detained at the Villawood Immigration Centre in Sydney.
It has been almost three months since the Foreign Ministry had in early September instructed the Malaysian High Commission to deliver the documents.
Following this, the Shah Alam High Court today instructed all parties to appear on Jan 5 next year to find out the status on this matter.
This comes after Setev's lawyer Sangeet Kaur Deo briefed deputy registrar Azlinda Mohd Sharif that there has been no response from the Malaysian High Commission after writing to them last month.
The amended statement of claim was filed following the conviction of Sirul and former Chief Inspector Azilah Hadri (photo) for murdering Setev's daughter, Altantuya, at a jungle clearing atop a hill in Puncak Alam between 10pm and 1am on July 18 and 19, 2006.
It was reported that Setev and two of Altantuya's children had filed a RM100 million suit against Azilah, Sirul, political analyst Abdul Razak Baginda and the government in 2008, over her death.
The two, who were part of the elite police Special Action Unit, were found guilty by the Federal Court of murdering Altantuya on Jan 13 this year.
Azilah now at Kajang prison
Azilah is now at Kajang prison while Sirul had left the country for Australia after the duo was previously acquitted by the Court of Appeal.
Following the conviction, a red-flag notice was issued on Interpol on Sirul, and he was arrested by the Australian authorities on Jan 23 in Brisbane.
Azilah and Sirul's lawyers have discharged themselves from representing them in the civil suit, as there were no instructions given.
Shah Alam High Court judge Suraya Othman had instructed Setev's lawyer to pass the documents to court for it to be sealed and then sent to the Foreign Ministry for it to be delivered to the Malaysian High Commission there.
This was because the lawyers might not have the jurisdiction to hand over the documents in Australia. - M'kini
