KUALA LUMPUR - Petaling Jaya Utara MP Tony Pua has been allowed to challenge the Immigration Department director-general’s decision to stop him from travelling overseas.
High Court (Appellate and Special Powers) judge Justice Asmabi Mohamad granted leave for a judicial review.
Pua wants the High Court to quash the decision by declaring it unlawful and invalid.
Speaking to reporters here Thursday, Pua's lawyer Gobind Singh Deo said the court had set Oct 15 for case management of substantive judicial review.
He said they would file documents for the hearing of the merits of the application.
The applicant, whose name is Pua Kiam Wee, has named the Immigration department director-general and the Government as respondents.
"The respondents will file affidavits to respond to our application and the judge will later fix a hearing date for merits of the application," added Gobind.
Senior Federal Counsel Shamsul Bolhassan said they have not objected the application for leave.
In his application for a judicial review, Pua said he was prevented from leaving the country at KLIA 2 on July 22.
The DAP national publicity secretary said he was supposed to go to Yogyakarta that day using his passport, which was valid until April 23, 2020.
He claimed that the decision was ineffective under the law as it was in contradiction to his legitimate rights to travel abroad using his valid passport.
Gobind had told the media that they had on July 24 written to the Immigration D-G demanding reasons why Pua had been stopped from leaving the country but did not get any response. - ANN
