KUALA LUMPUR: National Feedlot Corporation Sdn Bhd (NFCorp) chairman Dr Mohamad Salleh Ismail today successfully secured an ad interim injunction until Monday against former NFCorp consultant Shamsubahrin Ismail to restrain him from making further frivolous and malicious statements against Salleh.
The interim injunction was granted in the Kuala Lumpur High Court by Judge Mohd Zaki Abd Wahab pending the hearing of an application for an inter partes injunction which will take place next Monday.
Salleh had brought a suit for defamation and malicious falsehood claiming that Shamsubahrin had engaged in libel via a Facebook posting dated May 19 in which the latter had claimed that he had been made a “scapegoat” in the controversy surrounding NFCorp.
He also alleged that Shamsubahrin had made seven other defamatory postings, including one which he claimed had scandalized the judiciary, the government, the MACC, PDRM, the Attorney-General and the prime minister, with the sole purpose of injuring his reputation, character, credit and business.
Salleh was represented by lawyers Al Firdaus Shahrul Naing and Syed Ismat Syed Muhamad, while Zarina Ismail acted for Shamsubahrin.
Lawyers for Salleh indicated that they will be applying to disqualify Zarina from acting for Shamsubahrin, claiming that, as his sister, she was in a position of conflict of interest.
Separately, NFCorp has also initiated legal action to reclaim the RM1.75 million from the convicted consultant for failing to deliver business consultancy services as contracted.
