KUALA LUMPUR - A hopeful M. Indira Gandhi said it will “truly be a Malaysia Day” if she is reunited with the daughter snatched away by her Muslim ex-husband by September 16, after she secured a mandamus order compelling the police to return the child to her by next week.
Indira said she was “happy” with the Ipoh High Court’s decision today to order the Inspector-General of Police (IGP) to recover her six-year-old child from her Muslim ex-husband Mohd Ridzuan Abdullah within seven days.
“It will be truly a Malaysia Day,” she told Malay Mail Online when contacted today.
“Not only myself, I think the whole Malaysia will be happy of the decision,” the Hindu mother of three said.
She said the court’s ruling showed that there is hope for those trapped in similar interfaith child custody battles, saying “It will be a decision for non-Muslim people like me to at least get justice.”
Although Indira had endured numerous disappointments in the past five years in her bid to see her daughter again, she said today that her family was “crossing fingers” that the battle will soon be over.
“I think it’s enough of dragging. Hopefully everything will end soon,” she said.
Indira was separated from her daughter Prasana Diksa five years ago after Mohd Ridzuan took the 11-month-old toddler away in April 2009.
After Indira won full custody of her three children in the Ipoh High Court in 2010 and a recovery order for Mohd Ridzuan to return Prasana Diksa, the same court on May 30 cited him for contempt and issued a warrant to arrest and jail him unless he gave up the child.
Prasana is now with Mohd Ridzuan, while her two older siblings are with Indira, who has also managed to get the Ipoh High Court to quash Mohd Ridzuan’s unilateral conversion of the three children to become Muslims.
In May this year, the Ipoh High Court also annulled the Shariah courts’ 2009 order granting Mohd Ridzuan custody rights to the three children.
Today, Indira told Malay Mail Online that Ipoh High Court judge Lee Swee Seng had himself said that it would be nice if her daughter is returned to her by September 16.
When delivering his judgement after the judicial review hearing today on the IGP’s actions, the judge said Tan Sri Khalid Abu Bakar has to execute the civil court’s orders to fulfil his duty under the Police Act.
“The public has an expectation that the IGP, being the chief law enforcer, would execute his duties fairly and firmly, without fear or favour and that as we celebrate Malaysia Day, we can yet affirm that we are a country where the rule of law prevails, that no one is above the law and that the courts as established under the Constitution do not act in vain,” Lee said today in his grounds of judgement that was made available to Malay Mail Online.
The police had previously declined to enforce the warrant of arrest and the recovery order, citing the conflicting jurisdictions of the civil courts and Shariah courts.
But following today’s court ruling, the IGP will have to enforce the High Court’s previous orders to both arrest Mohd Ridzuan — who is believed to be in Kota Baru — and return Prasana to Indira. -Malay Mail
