'Menses' makes Azizah unfit as MB, lawyers say


PKR President Wan Azizah Wan Ismail may not be suitable to be the Selangor menteri besar because a woman suffers from "uzur syarie' (menses) and this means she can't accompany the sultan at these times.

The New Straits Times (NST) quoted lawyer Mohd Hafarizam Harun as a constitutional expert, saying that while there is no gender block under the Selangor constitution, there are practical concerns in choosing a woman as menteri besar.

"This is because should a woman menteri besar suffer from 'uzur sharie' (period), there will be many obstacles for her to accompany the sultan at religious functions.

"Hence, the article under the Selangor constitution for example may not hinder a woman from becoming a menteri besar, but by convention, there could be problems due to the said circumstances," Mohd Hafarizam (left) was quoted saying.

Under the headline of "Azizah may not be MB", the NST article said that Wan Azizah may not be able to perform religious obligations, even though she qualifies under the Selangor state constitution, which states that an MB must be "a member of the Malay race and professes the Muslim religion."

NST said that menteri besar has been "appointed from men" since independence, also noting that Article 51 (2) of the Selangor state Constitution 1959 also spelled out that a menteri besar is a "he."

This was despite prompting by several opposition party leaders to endorse the idea of a woman menteri besar, which would be the first for the country, the newspaper said.

NST reported that International Islamic University Malaysia (UIAM) lecturer Shamrahayu Abdul Aziz also agreed with Mohd Hafarizam's assessment that it was impractical to make Wan Azizah the Selangor MB.

"We also have to take into account sensitivities and taboos in society, as well as whether we are ready for a female menteri besar," he said, adding that during her period, a female MB may have to sit away from the sultan.

The idea of appointing Kajang MP Wan Azizah, also the wife of PKR defacto leader Anwar Ibrahim, as the Selangor MB comes amidstspeculation that two-term MB Abdul Khalid Ibrahim is under pressure to quit.

Besides Wan Azizah, PKR's deputy President Mohamed Azmin Ali has also been namechecked as a potential replacement for MB Khalid.
