PUTRAJAYA- HEALTH Ministry director-general Datuk Seri Dr Hasan Abdul Rahman has been instructed to go on leave until his fate is decided by the Public Services Commission (PSC) following his recent arrest for close proximity (khalwat).
Chief Secretary to the Government Datuk Seri Dr Ali Hamsa said the decision would be made by the commission's disciplinary board.
"A disciplinary action will be taken following criminal proceedings under the Public Officers Regulations (Conduct and Disipline) 1993. The ministry's secretary-general must take action under this proceeding by reporting it to the commission," Ali told reporters.
He said the official letter by the Health Ministry's secretary-general had been sent yesterday to the commission.
Dr Hasan was caught for committing khalwat (close proximity) at Pullman Putrajaya Lakeside Resort about 2.00am on Wednesday.
The health director-general and his partner were fined after pleaded guilty before Judge Mohd Amran Mat Zin for the offence under Section 27 (a) and 27 (b) of the Syariah Criminal Offences (Federal Territories) Act 1997.
He was fined RM3,000, and his female companion, Wan Syarifah Nooraazmanita Wan Hassan, 36, was fined RM2,900.
Meanwhile, PSC chairman Tan Sri Mahmood Adam said Dr Hasan's fate would be decided during the commission's meeting in Sabah on Monday.
Mahmood said six disciplinary actions could be taken against Dr Hasan and his partner, Wan Syarifah Nooraazmanita.
"They may either be given a warning notice, a demotion, a freeze in pay raise, loss of enrollment, job put on hold or lastly, being fired," he said.
Mahmood, howeversaid, the commission had yet to receive any official report concerning the case from the ministry's secretary-general, Datuk Kamarul Zaman Md Isa.
"I am still waiting for the report. The commission's weekly meeting will be held on Monday, and we will then decide on the disciplinary action that will be taken.
"The actions taken will depend on the report that has been submitted to us," he added.
Mahmood also said the commission would make a thorough study on the case to ensure fairness to those involved.
"We also need to look at the situation before making any decision concerning the case. For example, have they been sentenced by the court, whether they have pleaded guilty or not, or if the parties would consider to appeal.
"The commission does not want to interfere with the court decision because it would be subjudice or a contempt of court, when we take any disciplinary actions," he added.
